New Form I-9

The U.S. Citizenship and Immigration Services has released a new version of the Form I-9 and its instructions with an 08/01/2023 version date and a 07/31/2026 expiration date.

There have been several changes made to the new Form I-9:

  • Sections 1 and 2 are now on a single-sided sheet.
  • The form may be filled on tablets and mobile devices.
  • Section 1 Preparer/Translator Certification is now Supplement A, which employers can complete or provide to employees when necessary.
  • Section 3 – Reverification and Rehire is now Supplement B for reverifying eligibility to work or rehires (in either case copies of Section 2 documents are required). If you are completing the I-9 form in PDF/paper and submitting it to Central Payroll for processing; you will still just complete a new I-9 (Sections 1 and 2 only) for rehires or when reverifying eligibility to work.
  • The List of Acceptable Documents has been modified.
  • Form instructions have been consolidated to 8 pages.
  • Additionally, the U.S. Department of Homeland Security published a notice in the Federal Register allowing E-Verify employers the option to remotely examine I-9 documents.

We are working with the General Counsel’s Office on how this will affect Harvard’s I-9 collection processes going forward.

In the meantime, there will be no changes to how we currently verify I-9 documentation.

What does it mean for Hiring Departments?

  • All hiring departments using paper form I-9s should transition over to using the most current form with the 08/01/2023 effective date.
  • Central Payroll will be updating the Authorized Representative I-9 packet and instructions in the next few weeks.
  • Central Payroll will accept either version (expiration date 10/31/2022 or 07/31/2026 through 10/31/2023).
  • After 10/31/2023, I-9s that do not have the 07/31/2026 expiration date will be returned to hiring departments.
  • Schools and Units will continue to follow the current process of having an employee or authorized Section 2 completer review Section 2 documents in person.
  • Schools and Units using the Equifax Electronic I-9 do not need to do anything unless they are completing a paper form I-9.
